Our Legal Duties
We are required by law to maintain the privacy and security of your protected health information, provide you with this Notice, and follow the terms currently in effect. We will notify you if a breach of unsecured protected health information occurs.
How We May Use and Disclose Your Information
We may use and disclose your health information for treatment, payment, and health care operations. For example, we may use your information to provide psychiatric evaluation, medication management, psychotherapy, ADHD testing, coordinate care, submit claims, and manage practice operations.
Telehealth and Electronic Systems
EKM Psychiatry is a telehealth-first practice and uses secure electronic systems, including telehealth platforms, electronic health records, electronic prescribing, secure messaging, and patient portals. While we take reasonable steps to protect your information, electronic communications and technologies carry some inherent privacy and security risks.
Uses Requiring Your Authorization
We will obtain your written authorization before using or disclosing your information for purposes not otherwise permitted or required by law, including most uses of psychotherapy notes, marketing, and any sale of protected health information.
Your Rights
You have the right to request access to your records, request an amendment, request confidential communications, request restrictions, receive an accounting of certain disclosures, and obtain a paper copy of this Notice.

We comply with applicable New York and federal confidentiality laws, including laws that may provide added protection for mental health information and other specially protected records.
